Privacy Policy

This Privacy Policy explains how SpamCheck LLC (“SpamCheck,” “we,” “us,” or “our”) collects, uses, discloses, and protects information when you access or use SpamCheck’s websites, email addresses, applications, subscriptions, reports, responses, and related services (collectively, the “Services”).

By using the Services, you acknowledge the practices described in this Privacy Policy. If you do not agree with this Privacy Policy, do not use the Services or submit information to SpamCheck.

1. Information We Collect

A. Content You Submit for Analysis

When you submit or forward a suspicious communication, we may collect and process:

  • the body and subject of an email or message;
  • sender, recipient, reply-to, routing, header, and timestamp information;
  • links, domains, phone numbers, email addresses, and other identifiers contained in the submission;
  • attachments, screenshots, images, and documents;
  • metadata associated with the submitted content; and
  • any other information included in or attached to the submission.

Submitted content may contain personal information about you or other people. Before submitting content, remove information that is unnecessary for analysis, especially Social Security numbers, financial-account numbers, passwords, authentication codes, medical information, government identification numbers, and other highly sensitive information.

B. Account and Contact Information

We may collect information you provide when creating or managing an account, contacting us, or enrolling in the Services, including:

  • name;
  • email address;
  • telephone number;
  • account credentials;
  • communication preferences;
  • organization, community, employer, or sponsor affiliation; and
  • messages and other information you provide to customer support.

C. Subscription and Transaction Information

If you purchase a subscription or other paid Service, we and our payment providers may collect transaction information, including the subscription selected, amount charged, billing date, payment status, and limited payment-method details. Payment-card numbers are generally processed by our payment provider rather than stored directly by SpamCheck.

D. Information Collected Automatically

When you access the Services, we and our service providers may automatically collect:

  • IP address;
  • browser, device, and operating-system information;
  • device identifiers;
  • pages or features viewed;
  • referring and exit pages;
  • dates, times, and duration of activity;
  • approximate location derived from IP address;
  • interactions with our emails or website; and
  • diagnostic, crash, performance, security, and fraud-prevention data.

We may collect this information using cookies, pixels, local storage, logs, and similar technologies. See Section 7 for more information.

E. Information From Organizations and Other Sources

If access is provided through a senior-living community, credit union, employer, nonprofit, family member, or other sponsoring organization, we may receive limited enrollment information, such as your name, email address, eligibility status, and the applicable subscription or access level.

We may also receive information from security, fraud-prevention, identity-verification, analytics, hosting, email, and payment providers; public sources; and other users who submit content containing your information.

2. How We Use Information

We may use information to:

  • receive, scan, analyze, classify, and respond to submitted content;
  • identify possible spam, phishing, fraud, scams, malware, impersonation, or other suspicious activity;
  • provide explanations, risk assessments, and suggested next steps;
  • create and manage accounts, subscriptions, and sponsored access;
  • process payments and send transaction or service communications;
  • provide customer support and respond to inquiries;
  • maintain, monitor, troubleshoot, personalize, and improve the Services;
  • develop, test, evaluate, and improve detection methods, automated systems, and artificial-intelligence features;
  • detect, investigate, and prevent fraud, misuse, security incidents, and violations of our Terms and Conditions;
  • measure usage, performance, and engagement;
  • comply with legal obligations and respond to lawful requests;
  • establish, exercise, or defend legal claims; and
  • protect the rights, safety, property, and integrity of users, SpamCheck, our providers, and the public.

Where required by law, we rely on an appropriate legal basis for processing, such as your consent, performance of a contract, compliance with legal obligations, or our legitimate interests in providing, securing, and improving the Services.

3. Automated and Artificial-Intelligence Processing

SpamCheck uses automated systems, including artificial intelligence, to analyze submitted content and generate assessments or responses. To provide these features, submitted content and related information may be transmitted to and processed by technology, hosting, security, and artificial-intelligence service providers acting on our behalf.

Automated systems can make mistakes. A SpamCheck assessment should not be treated as a guarantee that content is safe, fraudulent, or accurately classified.

We may use submissions and related results to evaluate and improve the Services, including detection quality. Where practical, we may aggregate, de-identify, redact, filter, or minimize information used for these purposes. We do not attempt to reidentify information that has been de-identified, except where permitted by law to test whether our de-identification processes are effective.

4. How We Disclose Information

We may disclose information in the following circumstances:

A. Service Providers

We may disclose information to vendors and contractors that provide services on our behalf, such as cloud hosting, email processing, artificial intelligence, cybersecurity, analytics, customer support, communications, data storage, and payment processing. These providers may use information only as permitted by their agreements with us and applicable law.

B. Sponsoring Organizations

If an organization sponsors your access, we may provide that organization with limited enrollment, eligibility, billing, and aggregated usage information. We do not provide the sponsoring organization with the contents of your submissions or your individual SpamCheck results merely because it sponsors your access, unless you authorize the disclosure, it is clearly disclosed when you use the applicable program, or disclosure is required by law.

C. Legal, Safety, and Security Reasons

We may disclose information when we reasonably believe disclosure is necessary to:

  • comply with law, regulation, legal process, or a valid governmental request;
  • enforce our agreements and policies;
  • detect, prevent, or investigate fraud, abuse, security incidents, or illegal activity;
  • protect the rights, safety, or property of SpamCheck, our users, our providers, or the public; or
  • establish, exercise, or defend legal claims.

D. Business Transactions

Information may be disclosed or transferred as part of a merger, financing, acquisition, bankruptcy, reorganization, sale of assets, or similar corporate transaction. Where required, we will provide notice before personal information becomes subject to a materially different privacy policy.

E. With Your Direction or Consent

We may disclose information when you direct us to do so or provide consent.

F. Aggregated or De-identified Information

We may disclose information that has been aggregated or de-identified so that it cannot reasonably be linked to an identified or identifiable person.

5. Sale and Sharing of Personal Information

SpamCheck does not sell personal information for money. We also do not use or disclose personal information for cross-context behavioral advertising as those terms are defined under applicable U.S. state privacy laws.

We may disclose information to service providers for analytics, security, payment processing, communications, artificial-intelligence processing, and other operational purposes as described in this Privacy Policy. These operational disclosures are not intended to constitute a sale of personal information.

If our practices change, we will update this Privacy Policy and provide any choices required by law.

6. Data Retention

We retain personal information for as long as reasonably necessary to provide the Services, maintain accounts and transaction records, meet security and fraud-prevention needs, resolve disputes, enforce agreements, comply with legal obligations, and support legitimate business purposes.

Retention periods vary depending on the type of information, how it is used, the sensitivity of the information, and legal or operational requirements. Submitted content may be retained for analysis history, customer support, safety, service improvement, and abuse prevention. We may retain aggregated or de-identified information for longer periods.

When information is no longer reasonably necessary, we may delete, de-identify, or securely isolate it, subject to technical limitations and legal requirements. Information may remain temporarily in backups and disaster-recovery systems before being overwritten.

7. Cookies and Similar Technologies

We and our service providers may use cookies, pixels, software development kits, local storage, logs, and similar technologies to:

  • keep the Services functioning;
  • remember settings and preferences;
  • authenticate users;
  • protect accounts and prevent fraud;
  • understand how the Services are used;
  • diagnose errors and improve performance; and
  • measure communications and engagement.

You may be able to control cookies through your browser or device settings. Disabling certain technologies may affect the operation of the Services. Where required by law, we will provide additional notice or obtain consent for non-essential cookies.

8. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect information against unauthorized access, loss, misuse, alteration, or disclosure. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Email itself may not be a secure communication channel. Do not forward passwords, authentication codes, full payment-card numbers, financial-account credentials, Social Security numbers, or other information that is unnecessary for SpamCheck’s analysis.

9. Your Choices and Privacy Rights

Depending on where you live and subject to applicable exceptions, you may have the right to:

  • request access to personal information we maintain about you;
  • request correction of inaccurate personal information;
  • request deletion of personal information;
  • receive a portable copy of certain personal information;
  • withdraw consent where processing is based on consent;
  • opt out of certain sales, sharing, targeted advertising, or profiling activities;
  • restrict or object to certain processing; and
  • appeal our denial of a privacy request.

To submit a request, email support@spamcheck.com with the subject line “Privacy Request.” Describe your request and provide the email address associated with your use of the Services.

We may need to verify your identity before completing a request. We will use information provided for verification only to process the request. An authorized agent may submit a request where permitted by law, but we may require proof of authorization and identity verification.

We will not discriminate against you for exercising applicable privacy rights. If we deny your request, you may appeal by replying to our decision and stating that you wish to appeal.

Please note that deleting submitted content may limit our ability to provide submission history or related features. We may retain information where permitted or required by law, including for security, fraud prevention, transactions, legal compliance, and dispute resolution.

10. Marketing Communications

You may opt out of promotional emails by using the unsubscribe link in the message or contacting us. Even if you opt out of marketing, we may continue sending non-promotional communications concerning your account, submissions, subscriptions, security, transactions, or changes to the Services.

11. Children’s Privacy

The Services are intended for adults and are not directed to children under 13. We do not knowingly collect personal information directly from children under 13. If you believe a child under 13 has provided personal information to us, contact us at support@spamcheck.com so we can investigate and take appropriate action.

12. International Users

SpamCheck is based in the United States. If you access the Services from another country, your information may be transferred to, stored in, and processed in the United States and other locations where we or our service providers operate. Privacy laws in those locations may differ from those in your country.

Where required, we use legally recognized safeguards for international data transfers. Users in certain jurisdictions may have additional rights described in Section 9.

13. Third-Party Services and Links

The Services may contain links to or interact with third-party websites, email providers, payment processors, and other services. This Privacy Policy does not apply to the privacy practices of third parties, and we are not responsible for their actions. Review their privacy policies before providing information to them.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will post the updated version and revise the Effective Date. If changes are material, we will provide additional notice as required by law. Your continued use of the Services after an updated policy takes effect means that the updated policy will apply to your subsequent use of the Services.
