Terms and Conditions

These Terms and Conditions (the “Terms”) govern your access to and use of SpamCheck’s websites, email addresses, applications, subscriptions, reports, responses, and related services (collectively, the “Services”). The Services are operated by SpamCheck LLC (“SpamCheck,” “we,” “us,” or “our”).

By accessing or using the Services, creating an account, purchasing a subscription, or submitting content to SpamCheck, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. What SpamCheck Does

SpamCheck allows users to submit or forward emails, messages, links, attachments, images, and related information for automated and, where applicable, human-assisted analysis. SpamCheck may provide a risk assessment, explanation, or suggested next steps intended to help users identify potential spam, phishing, fraud, scams, malware, impersonation, or other suspicious activity.

SpamCheck is an informational assistance tool. It is not a substitute for your own judgment, independent verification, or advice from law enforcement, a financial institution, an attorney, an accountant, a cybersecurity professional, or another qualified professional.

2. No Guarantee of Accuracy or Safety

Scams and security threats change constantly. SpamCheck uses automated systems, including artificial intelligence, which may make mistakes. The Services may incorrectly classify safe content as suspicious or suspicious content as safe. A SpamCheck result is not a guarantee that any person, message, link, attachment, transaction, account, or communication is legitimate, accurate, secure, or free from harmful content.

You should not send money, disclose sensitive information, download a file, click a link, grant remote access, or take another consequential action solely because of a SpamCheck result. When in doubt, contact the relevant person or organization through independently verified contact information.

You remain solely responsible for decisions and actions taken in reliance on the Services.

3. Emergencies and Active Fraud

SpamCheck is not an emergency service, law-enforcement agency, bank, credit bureau, identity-theft recovery service, or real-time monitoring service. We do not guarantee any response time.

If you believe money, account credentials, identity information, or other sensitive information has already been compromised, immediately contact the relevant financial institution or service provider using independently verified contact information and report the incident to the appropriate authorities.

4. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

5. Accounts and Account Security

Some features may require an account. You agree to provide accurate, current information and to keep your login credentials confidential. You are responsible for activity occurring through your account, except to the extent caused by SpamCheck’s failure to use reasonable security measures.

Notify us promptly at support@spamcheck.com if you believe your account or credentials have been compromised.

6. Submitted Content and Permission to Analyze It

The Services may allow you to submit or forward emails, messages, attachments, screenshots, links, headers, sender information, contact details, and other materials (“Submitted Content”).

You retain any rights you have in your Submitted Content. You grant SpamCheck and its service providers a worldwide, non-exclusive, royalty-free license to host, copy, transmit, scan, analyze, process, reproduce, and otherwise use Submitted Content as reasonably necessary to provide, secure, maintain, support, and improve the Services; investigate abuse; comply with law; and enforce these Terms.

You represent that you have all rights and permissions necessary to submit the Submitted Content and authorize this processing. You agree not to submit content that you are prohibited from sharing or that unlawfully infringes another person’s privacy, confidentiality, intellectual-property, or other rights.

Before forwarding content, you should remove unnecessary sensitive information, including Social Security numbers, financial-account numbers, passwords, authentication codes, medical information, and private information belonging to others.

Our collection and handling of personal information is described in our Privacy Policy.

7. Acceptable Use

You may not use the Services to:

  • violate any law or another person’s rights;
  • send spam, phishing messages, malware, or deceptive communications;
  • test, develop, improve, or facilitate scams, fraud, surveillance, harassment, or other harmful conduct;
  • submit content you do not have the right to share;
  • impersonate another person or misrepresent your identity or affiliation;
  • probe, scan, disrupt, overload, reverse engineer, scrape, or attempt unauthorized access to the Services or related systems;
  • bypass usage limits, security measures, access controls, or payment requirements;
  • use automated means to access the Services without our written permission; or
  • resell, sublicense, or commercially exploit the Services except under a separate written agreement with SpamCheck.

We may investigate suspected misuse and may suspend or terminate access when we reasonably believe it is necessary to protect users, SpamCheck, our providers, or the public.

8. Subscriptions, Fees, and Billing

Some Services may be free, offered on a trial basis, included through a sponsoring organization, or require a paid subscription. Prices, billing intervals, included features, usage limits, and applicable taxes will be disclosed before purchase.

If you purchase an automatically renewing subscription, you authorize SpamCheck and its payment processor to charge the disclosed fees and applicable taxes to your selected payment method at the start of each billing period until you cancel. You may cancel through the method described at purchase or in your account settings. Unless otherwise stated at purchase, cancellation takes effect at the end of the current paid billing period.

Except where required by law or expressly stated otherwise, fees already paid are nonrefundable and we do not provide credits for partially used billing periods. If a payment fails, we may retry the charge, limit access, or suspend the applicable Services.

Subscriptions purchased through a third-party platform may also be governed by that platform’s billing, cancellation, and refund terms.

9. Organizational and Sponsored Access

An employer, senior-living community, credit union, nonprofit, family member, or other organization may purchase or sponsor access for users. Sponsored access may be subject to additional terms between SpamCheck and the sponsoring organization. A sponsor does not receive Submitted Content or individual results merely because it pays for access unless this is clearly disclosed, authorized, or required by law.

SpamCheck may modify or discontinue sponsored access if the sponsoring arrangement ends. You may then be offered the option to continue using the Services directly.

10. Third-Party Services and Content

The Services may reference or interact with third-party websites, email providers, payment processors, software, links, or services. SpamCheck does not control and is not responsible for third-party services, content, availability, security, or practices. Your use of third-party services is governed by their own terms and policies.

11. Ownership

SpamCheck and its licensors own the Services, including the software, models, workflows, designs, text, graphics, trademarks, reports, and other materials we provide, excluding Submitted Content and third-party materials. Subject to these Terms, SpamCheck grants you a limited, personal, non-exclusive, non-transferable, revocable right to use the Services for their intended purpose.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Services except as permitted by law or with our written permission.

If you provide feedback or suggestions, you grant SpamCheck permission to use them without restriction or compensation.

12. Service Changes and Availability

We may add, modify, limit, suspend, or discontinue features or portions of the Services. We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free, or that Submitted Content will be stored for any particular period. You are responsible for retaining copies of materials you may need.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” SPAMCHECK AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, SECURITY, AND QUIET ENJOYMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL IDENTIFY EVERY SCAM OR THREAT, THAT ANY RESULT WILL BE COMPLETE OR CORRECT, OR THAT USE OF THE SERVICES WILL PREVENT FRAUD, FINANCIAL LOSS, IDENTITY THEFT, DATA LOSS, MALWARE, OR OTHER HARM.

Some jurisdictions do not allow certain warranty disclaimers, so some of the above may not apply to you.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPAMCHECK AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF MONEY, PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR SECURITY, ARISING OUT OF OR RELATING TO THE SERVICES, EVEN IF ADVISED THAT SUCH DAMAGES ARE POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF SPAMCHECK AND THE OTHER SPAMCHECK PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO SPAMCHECK FOR THE SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) $100.

These limitations apply regardless of the form of action and even if a remedy fails of its essential purpose. They do not apply to liability that cannot be limited or excluded under applicable law.

15. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless SpamCheck and its affiliates, officers, directors, employees, contractors, licensors, and service providers from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from or relating to: (a) your Submitted Content; (b) your misuse of the Services; (c) your violation of these Terms; or (d) your violation of another person’s rights.

If you are a consumer in a jurisdiction that does not permit this obligation, this section applies only to the extent permitted by law.

16. Suspension and Termination

You may stop using the Services at any time. We may suspend or terminate your access if you materially violate these Terms, create risk or potential legal exposure, fail to pay applicable fees, misuse the Services, or if suspension is reasonably necessary to protect the Services, users, or third parties.

Upon termination, your right to use the Services ends. Provisions that by their nature should survive termination will survive, including provisions concerning ownership, disclaimers, limitations of liability, indemnification, disputes, and general terms.

17. Dispute Resolution; Binding Arbitration; Class-Action Waiver

Please read this section carefully. It affects your legal rights.

Before filing a claim, you and SpamCheck agree to try to resolve the dispute informally. A party must send written notice describing the dispute and requested relief. Notices to SpamCheck must be sent to support@spamcheck.com and to the mailing address in Section 22. If the dispute is not resolved within 30 days after receipt of notice, either party may initiate arbitration.

Except for disputes eligible for small-claims court and requests for injunctive or equitable relief relating to intellectual property, unauthorized access, or misuse of the Services, any dispute arising out of or relating to these Terms or the Services will be resolved through binding individual arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules. The Federal Arbitration Act governs this section.

Arbitration will take place on an individual basis only. You and SpamCheck waive the right to a jury trial and the right to participate in a class, collective, consolidated, or representative action or arbitration. If this class-action waiver is found unenforceable as to a particular claim, that claim must proceed in court and not in arbitration.

You may opt out of this arbitration agreement by emailing support@spamcheck.com within 30 days after first accepting these Terms. Your opt-out notice must include your full name, the email address associated with your use of the Services, and a clear statement that you wish to opt out of arbitration.

Nothing in this section prevents either party from reporting conduct to a government agency.

18. Governing Law and Venue

These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs Section 17. For disputes not subject to arbitration, you and SpamCheck consent to the exclusive jurisdiction of the state and federal courts located in Bernalillo County, New Mexico, unless applicable consumer law requires otherwise.

19. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated Terms and revise the Effective Date. If changes are material, we will provide notice as required by law. Your continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms. If you do not agree to an update, you must stop using the Services.

20. Electronic Communications

You consent to receive agreements, disclosures, notices, receipts, and other communications electronically. Transactional and service-related communications are not marketing messages and may be necessary to provide the Services. Where required, we will obtain separate consent for marketing communications, and you may opt out of marketing as described in those communications.

21. General Terms

These Terms and any policies or additional terms incorporated by reference constitute the entire agreement between you and SpamCheck regarding the Services. If any provision is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain in effect.

Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. SpamCheck may assign these Terms in connection with a merger, acquisition, financing, sale of assets, corporate reorganization, or by operation of law.

No agency, partnership, joint venture, employment, or fiduciary relationship is created by these Terms.
